Fourth Circuit (unpublished!?) opinion follows Skoien on Heller challenge to § 922(g)(9) ... just after Seventh Circuit vacates it

"This Chester ruling by the Fourth Circuit excites me because, as regular readers know, I think the criminal prohibition on gun possession by misdemeanants in § 922(g)(9) is constitutionally questionable in the wake of Heller, and I believe lower courts have been too ready and eager to dismiss Second Amendment attacks on § 922(g)(9).

But... this Chester ruling by the Fourth Circuit annoys me because, apparently in order to try to keep this important ruling below the radar screen, the panel decided to denominate this opinion "unpublished" so that it is "not binding precedent in this circuit." Because this Chesterruling breaks new ground and provides important guidance on a frequently arising issue, I cannot fathom a valid reason why it should be "unpublished."

It sqeaked by with two votes in the house and Pelosi was ea to ear grins, (somebody make a joker face out of that grin) on A Saturday night. I was switching between that and the FSU Clemson Game. Now on to the Senate which will be more difficult, let hope.

This follows the excellent post by "Why Me" regarding the role of the US Army plays in "nation-building". From a practical standpoint, what is our interest? The misinformed continually cite Japan and Germany as success stories. Yes, we all agree. However, these represent the select few or "outliers". I would argue that in Germany's case, the proximity of wealthy nations surrounding the country that help promote trade played a large role in their success. Further, how do we expect that to work for Iraq? Will Syria, Saudi Arabia, or Iran come to the rescue? Will the institutions of government be sound? I am going to hazard a guess, I don't expect this to be true.

But why, when America's mini-mills and steel mills are among the most efficient on earth — in terms of man hours needed to produce a ton of steel — aren't those jobs coming back?

Answer: It is due to the free-trade policies of Bush and McCain, which permit trade rivals to impose value-added taxes of 15 percent to 20 percent on steel imports from the United States while rebating those taxes on steel exports to the United States. We are getting it in the neck coming and going.

An America First trade and tax policy could have U.S. steel mills rising again, while those in Japan, China, Russia and Brazil would be shutting down as uncompetitive in the U.S. market.

But we no longer put America first.

You know, I have to disagree with Mr. Buchanan. Based on a review of the available data, wage and salary disbursements by private industry rose 52% in the period 1998-2007. Further, personal income has risen by 230% in the period 1985-2007.

I would suggest that we need to do more to promote free trade. It is true there are "losers" in the equation of free trade. However, the societal benefits as a whole far outweigh the negative impact on specific individuals.

I do agree with Mr. Buchanan when he states that we need to stop giving out subsidies to the steel industry. We should promote a level playing field for all industries. I do believe that if the government chose to step out of the way, the jobs lost in one industry will be gained in another as we unleash the entrepreneurial spirit of the American public.

According to a story over on Newsmax there is a scientist that is saying forget global warming, the new concern is global cooling. Haven't we already been down this road? Have we not already worried about a little ice age a few decades ago? What is the reason for this renewed concern? What is the evidence? Sunspots, or rather the lack thereof. There is a picture that the scientist refers to which shows the sun without any sunspots. Ok....and? Well apparently, there is a correlation between sunspot cycles and the earth's climate. The spaceweather.com website has way more than you probably care about with regard to sunspots and what they mean in relation to weather. I don't want to get off in the weeds on the science of this, mainly because I can't. I'm not a weather guy, the point is we no longer use the term "global warming", it's now referred to as "climate change". Why is that? Because global warming is BS, and this is starting to take hold one small step at a time. Of course, if we can finally discount this myth then there must be some other crisis that we have to deal with. And this may be it, a recycled global crisis from a few decades ago. The shift in the terminology to "climate change" is a hedge, the inconvenient truth bandwagoneers have cleverly placed this "out" so they can keep the "crisis" going. Just think how we could inflate this crisis to include the ramifications of global cooling coupled with the current oil situation. PEOPLE WILL NOT BE ABLE TO AFFORD TO HEAT THEIR HOMES! PEOPLE WILL FREEZE TO DEATH IN THEIR HOMES! Just wait. Please Mr. Chavez won't you donate some more of your Venezualan oil to the poor people of America. Joe Kennedy needs your help to heat their homes.
